Welcome to CosmoDigest. The CosmoDigest website (cosmodigest.io), mobile applications, newsletters, and all related services (collectively, the "Service") are owned and operated by SEVENCUBED, LLC, a New Jersey limited liability company ("Company," "we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of the Service. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

1. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Be a licensed beauty professional or salon/spa business owner (for Pro tier)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

By registering for an account, you represent and warrant that you meet all eligibility requirements.

2. Account Registration

To access certain features, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach
• Verify your email address before accessing dashboard features

Email Verification

Email verification is required for all accounts. You will not be able to access the dashboard or any paid features until you verify your email address by clicking the verification link sent to you upon registration.

Account Security

We implement rate limiting and other security measures to protect your account and our Service from unauthorized access. Repeated failed login attempts may result in temporary account lockouts. We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

3. Service Description and Purpose

CosmoDigest is an information aggregation and curation service designed to help anyone in the beauty industry stay informed. Our purpose is to help you access important information as quickly as possible. We provide:

• Curated industry news and content aggregated from third-party sources
• Trend analysis and insights from social media and industry data
• Regulatory and compliance news from federal and state sources
• Personalized newsletters delivered to your email
• Professional license verification services
• Business and financial news relevant to the beauty industry

4. Subscription Plans and Billing

Available Plans

• Free: Weekly newsletter, search, and 7-day archive
• Pro ($10/month): Full dashboard, trend analytics, regulatory alerts, 90-day archive, saved articles, and exclusive reports

Billing Terms

• Subscriptions are billed monthly or annually in advance
• Annual subscriptions receive a discount equivalent to 2 months free
• Prices are in US dollars and exclude applicable taxes
• We may change subscription prices with 30 days' notice
• Price changes do not affect current billing periods

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel anytime from your dashboard.

5. Cancellation and Refunds

Cancellation

• You may cancel your subscription at any time from Dashboard → Subscription
• Cancellation takes effect at the end of your current billing period
• You retain access to paid features until your subscription expires
• After expiration, your account reverts to the Free tier

Refund Policy

• 14-Day Guarantee: Full refund available within 14 days of your first paid subscription
• After 14 days, refunds are not provided for the current billing period
• Annual subscriptions may be eligible for prorated refunds at our discretion
• Refund requests should be sent to hello@cosmodigest.io

6. License Verification

Pro tier users may verify their professional licenses. By submitting license information, you represent that:

• The license belongs to you and is currently valid
• All information provided is accurate and complete
• You authorize us to verify the information with relevant authorities
• You will not submit fraudulent, altered, or expired documents

Limitations: Our license verification is for authentication purposes only. We are not a state licensing authority and do not guarantee the current status of any license. Always verify license status directly with your state board.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Share your account credentials with others
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or its infrastructure
• Scrape, copy, or redistribute our content without permission
• Submit false or misleading license information
• Use the Service to compete with CosmoDigest
• Violate any applicable laws or regulations
• Harass, abuse, or harm other users or our staff

Violation of these terms may result in immediate account suspension or termination.

8. Intellectual Property

Our Content

The Service, including its design, features, logos, and original content, is owned by CosmoDigest and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Third-Party Content

Much of the news content displayed in the Service is aggregated from third-party sources. All rights to such content remain with the original publishers. We provide links and summaries under fair use principles for informational purposes.

Your Content

You retain ownership of content you submit (such as feedback or support requests). By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and process that content in connection with providing the Service.

You agree to indemnify, defend, and hold harmless CosmoDigest, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

We may suspend or terminate your access to the Service at any time, with or without cause, including for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended periods of inactivity
• Requests from law enforcement or government agencies

Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination shall survive (including indemnification, limitation of liability, and dispute resolution).

Informal Resolution: Before filing any legal claim, you agree to contact us at hello@cosmodigest.io to attempt to resolve the dispute informally for at least 30 days.

Governing Law: These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

Jurisdiction: Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in New Jersey.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service at least 30 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you disagree with changes, you must stop using the Service and cancel your subscription.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and CosmoDigest.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.
• Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
